Terms & Conditions

For the purposes of these Terms:

• "Account" means the registered user account created on the Platform.
• "AI Services" means conversational AI, reminders, wellbeing insights, reports, recommendations, summaries, and other artificial intelligence features provided by KinKeeper.
• "Care Recipient" means the senior citizen or other individual whose information is added to the Platform.
• "Family Member" means any person authorised by the User to access or receive updates regarding a Care Recipient.
• "Kiki" means the AI-powered digital companion made available through KinKeeper.
• "Subscription" means any paid or free plan offered by KinKeeper.
• "Third-Party Service Provider" includes doctors, hospitals, pathology laboratories, pharmacies, caregivers, diagnostic centres, wellness providers, home healthcare providers, emergency service providers, equipment rental partners, teleconsultation providers, and any other independent service provider integrated with the Platform.

To use KinKeeper, you represent and warrant that:

• You are at least eighteen (18) years of age.
• You have the legal capacity to enter into a binding contract.
• All information provided by you is accurate, complete, and up to date.
• Where you register or upload information relating to another individual, including a parent, family member, or Care Recipient, you have obtained all permissions, consents, and lawful authority required under applicable law.

LIFE EASE SERVICES LLP reserves the right to refuse registration or terminate any account if any information is found to be false, misleading, incomplete, or fraudulent.

By clicking “I Agree”, creating an Account, or continuing to access or use the Platform, you expressly consent to enter into an electronic contract with LIFE EASE SERVICES LLP in accordance with the Information Technology Act, 2000.

Electronic records and electronic acceptance shall have the same legal effect as physical signatures.

KinKeeper is an AI-powered hybrid senior care platform that assists families in supporting their elderly loved ones through technology-enabled services, including AI conversations, reminders, wellbeing monitoring, family dashboards, care coordination, and access to selected independent third-party service providers.

KinKeeper is not:

• a hospital;
• a medical clinic;
• a nursing home;
• an ambulance operator;
• a diagnostic laboratory;
• a pharmacy;
• a health insurance company; or
• a provider of emergency medical services.

KinKeeper functions solely as a technology platform and care coordination facilitator. Unless expressly stated otherwise in writing, LIFE EASE SERVICES LLP does not employ or control independent doctors, laboratories, pharmacies, caregivers, or other Third-Party Service Providers available through the Platform.

You may be required to create an Account to access certain features of the Platform.

You agree to:

• provide true, accurate, and complete information;
• promptly update any changes to your information;
• maintain the confidentiality of your login credentials;
• immediately notify KinKeeper of any unauthorised use of your Account.

You are solely responsible for all activities conducted through your Account, whether authorised by you or not.

KinKeeper shall not be liable for any loss arising from unauthorised access resulting from your failure to protect your credentials.

Depending upon the Subscription selected, KinKeeper may offer:

• AI-powered conversations through Kiki;
• medication reminders;
• appointment reminders;
• wellbeing reminders;
• family notifications;
• KinKeeper Wellbeing Reports (KWR);
• health record storage;
• emergency information storage;
• family dashboard access;
• voice and text interactions;
• care coordination;
• service booking through independent partners;
• access to selected third-party healthcare, wellness, and home support services.

The availability of any feature is subject to technical feasibility, geographic availability, subscription plan, applicable law, and operational requirements.

LIFE EASE SERVICES LLP reserves the unrestricted right to add, modify, suspend, replace, or discontinue any feature, functionality, integration, or service at any time without incurring liability, subject to applicable law.

KinKeeper incorporates artificial intelligence technologies designed to provide conversational assistance, reminders, summaries, and informational support.

You acknowledge and agree that:

• AI-generated responses are automatically generated and may be incomplete, inaccurate, outdated, misleading, or unsuitable for your specific circumstances.
• AI Services are intended solely for informational and convenience purposes.
• AI Services do not constitute medical, legal, financial, psychological, or professional advice.
• AI outputs should never be relied upon as the sole basis for making decisions affecting health, safety, finances, or legal rights.
• Users are solely responsible for independently verifying all important information before acting upon it.

LIFE EASE SERVICES LLP makes no representation or warranty regarding the accuracy, completeness, reliability, or suitability of any AI-generated content.

To the fullest extent permitted by law, LIFE EASE SERVICES LLP shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from reliance on AI-generated responses.

KinKeeper does not provide medical diagnosis, treatment, prescriptions, clinical opinions, nursing services, or emergency healthcare.

Any health-related information made available through the Platform, including AI-generated suggestions, reminders, reports, or summaries, is intended solely for informational purposes and should not be construed as medical advice.

Users should immediately consult a qualified medical practitioner in the event of illness, injury, medical symptoms, or health concerns.

In case of a medical emergency, users must immediately contact the appropriate emergency services, ambulance providers, or nearest hospital.

Under no circumstances shall KinKeeper be responsible for any medical outcome, delayed treatment, misdiagnosis, medication error, injury, disability, or death arising directly or indirectly from the use of the Platform or reliance upon information provided through it, except where liability cannot be excluded under applicable law.

Certain Subscription plans may include SOS or emergency notification features.

These features are provided solely as technological conveniences and do not constitute emergency response services.

Users acknowledge that emergency notifications depend upon several factors outside the control of KinKeeper, including but not limited to:

• internet connectivity;
• mobile network availability;
• device battery status;
• GPS accuracy;
• device permissions;
• operating system settings;
• third-party messaging services;
• cloud infrastructure; and
• telecom network performance.

Accordingly, LIFE EASE SERVICES LLP does not guarantee that emergency alerts will be transmitted, received, acknowledged, or acted upon within any specified period or at all.

Users should never rely exclusively upon the Platform during an emergency.

KinKeeper may facilitate access to independent Third-Party Service Providers, including healthcare professionals, pathology laboratories, pharmacies, wellness providers, home care providers, caregivers, equipment rental partners, and teleconsultation providers.

All such providers operate independently of LIFE EASE SERVICES LLP.

Unless expressly stated otherwise, KinKeeper:

• does not employ such providers;
• does not supervise their professional services;
• does not guarantee their availability, qualifications, pricing, quality, licensing, competence, or performance;
• is not responsible for any acts, omissions, negligence, misconduct, delays, cancellations, billing disputes, or professional decisions of such providers.

Any contract for services entered into between a User and a Third-Party Service Provider is solely between those parties.

LIFE EASE SERVICES LLP shall not be liable for any claim, loss, injury, damage, expense, or dispute arising out of services rendered by any Third-Party Service Provider.

KinKeeper may offer free, paid, promotional, trial, family, corporate, or enterprise subscription plans (“Subscription Plans”). The features, pricing, validity, and benefits of each Subscription Plan shall be displayed on the Platform or otherwise communicated by KinKeeper.

LIFE EASE SERVICES LLP reserves the right, at its sole discretion, to introduce, modify, suspend, replace, discontinue, or withdraw any Subscription Plan, feature, benefit, promotional offer, or pricing structure at any time, subject to applicable law.

Subscription Plans are personal to the registered User and may not be assigned, transferred, sublicensed, shared, or resold without the prior written consent of LIFE EASE SERVICES LLP.

All payments made through the Platform shall be processed through authorised third-party payment gateways.

By making a payment, you represent and warrant that:

• the payment method belongs to you or you are authorised to use it;
• all payment information provided is accurate and complete; and
• you have sufficient authority to complete the transaction.

Unless otherwise specified:

• all prices are in Indian Rupees (INR);
• applicable GST and other statutory taxes shall be charged in addition to the displayed price where required by law;
• payment processing charges, if any, shall be borne by the User unless expressly stated otherwise.

LIFE EASE SERVICES LLP shall not be liable for payment failures, delays, banking errors, gateway outages, declined transactions, or technical issues attributable to banks, payment processors, or third-party service providers.

Unless otherwise required under applicable law or expressly stated in a separate refund policy:

• Subscription fees are non-refundable.
• Partially used subscriptions shall not be refunded.
• Unused benefits shall not carry forward.
• Promotional, discounted, complimentary, or trial subscriptions are non-refundable.
• Cancellation of a Subscription shall not entitle the User to any refund for the remaining subscription period.

LIFE EASE SERVICES LLP may, at its sole discretion and without creating any legal obligation or precedent, approve refunds in exceptional circumstances.

The User agrees to:

• provide accurate and up-to-date information;
• promptly update changes to profile or Care Recipient information;
• maintain the confidentiality of login credentials;
• use the Platform only for lawful purposes;
• comply with all applicable laws and regulations.

The User shall not:

• impersonate any individual or entity;
• provide false, misleading, or fraudulent information;
• upload malicious software, viruses, or harmful code;
• interfere with the security or operation of the Platform;
• attempt to gain unauthorised access to systems or data;
• misuse the SOS or emergency features;
• harass, threaten, abuse, or defame any person through the Platform;
• engage in activities that may damage the reputation, goodwill, or operations of KinKeeper.

LIFE EASE SERVICES LLP reserves the right to investigate suspected violations and take appropriate action, including suspension or termination of access.

KinKeeper enables Users to create profiles and upload information relating to parents, senior citizens, dependants, or other Care Recipients.

By uploading such information, the User represents and warrants that:

• the information is accurate to the best of their knowledge;
• they have obtained all permissions, authorisations, and consents required under applicable law;
• they have lawful authority to upload and manage such information on behalf of the Care Recipient.

LIFE EASE SERVICES LLP shall not be responsible for verifying such authority and may rely on the User's representations.

The User agrees to indemnify and hold harmless LIFE EASE SERVICES LLP against any claim arising from unauthorised collection, use, disclosure, or upload of another person's information.

LIFE EASE SERVICES LLP reserves the right to request documentary proof of authorisation or consent and may suspend access until satisfactory verification is received.

Users are solely responsible for ensuring that any health-related information, including medications, allergies, diagnoses, appointments, emergency contacts, and medical history, is accurate, complete, and regularly updated.

KinKeeper relies on information provided by the User and does not independently verify its accuracy.

LIFE EASE SERVICES LLP shall not be liable for any consequences resulting from inaccurate, incomplete, outdated, or misleading information provided by Users.

By creating an Account or using the Platform, the User consents to receive communications electronically, including through:

• email;
• SMS;
• WhatsApp;
• in-app notifications;
• push notifications;
• telephone calls; and
• other digital communication channels.

Such communications may include:

• service updates;
• account notifications;
• security alerts;
• reminders;
• subscription information;
• invoices;
• promotional communications (where permitted by law).

Electronic communications shall be deemed to satisfy any legal requirement that such communications be in writing.

The collection, use, storage, processing, and disclosure of personal data are governed by the KinKeeper Privacy Policy, which forms an integral part of these Terms.

By using the Platform, the User consents to the processing of personal data as described in the Privacy Policy.

LIFE EASE SERVICES LLP implements reasonable administrative, technical, and organisational safeguards to protect personal information. However, no electronic system is completely secure.

Accordingly, LIFE EASE SERVICES LLP does not warrant or guarantee absolute security of information transmitted over the internet or stored electronically. To the maximum extent permitted by law, LIFE EASE SERVICES LLP shall not be liable for unauthorised access, cyberattacks, hacking incidents, malware, ransomware, data interception, telecommunications failures, cloud service outages, or other events beyond its reasonable control.

The Platform may permit Users to upload text, images, voice recordings, health information, documents, messages, feedback, and other content (“User Content”).

The User retains ownership of User Content but grants LIFE EASE SERVICES LLP a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, analyse, transmit, display, and use such User Content solely for operating, maintaining, improving, securing, and providing the Platform and its services.

The User represents and warrants that:

• they own or have the necessary rights to upload the User Content;
• the User Content does not infringe the rights of any third party;
• the User Content does not contain unlawful, defamatory, obscene, or harmful material.

LIFE EASE SERVICES LLP reserves the right, without prior notice, to remove, restrict, or refuse any User Content that violates these Terms or applicable law.

If the User provides suggestions, ideas, recommendations, comments, or other feedback relating to KinKeeper, the User grants LIFE EASE SERVICES LLP an irrevocable, perpetual, worldwide, royalty-free, transferable, and sublicensable right to use, modify, reproduce, commercialise, and incorporate such feedback into its products or services without compensation, attribution, or further consent.

All intellectual property rights relating to the Platform, including but not limited to the KinKeeper name, the Kiki AI Companion, logos, trademarks, service marks, domain names, software, mobile applications, source code, object code, databases, algorithms, AI models, prompts, workflows, reports, graphics, icons, layouts, designs, text, audio, video, documentation, and all other proprietary materials, are and shall remain the exclusive property of LIFE EASE SERVICES LLP and/or its licensors.

Nothing contained in these Terms shall be construed as granting the User any ownership rights or licence except for the limited right to use the Platform for its intended personal purposes.

The User shall not copy, reproduce, modify, reverse engineer, decompile, distribute, sell, licence, lease, scrape, create derivative works from, or commercially exploit any part of the Platform without prior written permission from LIFE EASE SERVICES LLP.

Unauthorised use of the Platform or its intellectual property may result in civil and criminal proceedings under applicable law.
